Debating Kagan Pros and Cons

I am not sold on Kagan as a Supreme Court Justice but I am not reflexively opposed either (not that Obama or the Senate care either way). I do support a rational discussion of the nomination, like that provided by Rachel Maddow last night.

What I do oppose is the Republican habit of opposing for the sake of opposing and then mining the record for irrelevant talking points against.
Kagan agrees with the late Thurgood Marshall that the U.S. Constitution as originally drafted was imperfect because, for example, it allowed slavery and did not enfranchise women . The GOP clutches its skirts as though the elephant had seen a mouse.

It would be helpful if for once, the Republicans could act like grownups and debate real issues instead of dragging out their overworked character assassination shtick.

But what do I know. I’m no lawyer.
